Violation of the human rights of the Romanian ethnic minority in Serbia
Motion for a resolution
presented by Mr Cubreacov and othersConsidering its rapporteurs’ periodic reports for Serbia and Montenegro on the functioning of democratic institutions in that country;
Observing that the Romanian ethnic minority inhabits 39 ethnic Romanian or mixed localities in the province of Vojvodina and 154 ethnic Romanian localities and 48 mixed localities between the Danube, the Timok and the Morava (eastern Serbia);
Regretting that Serbia applies double standards by creating an artificial separation between the Romanians of Vojvodina and the Romanians of eastern Serbia by refusing to recognise the latter group’s self-designated ethnic identification (Romanians) and imposing the ethnic tag of “Vlachs” on them;
Noting that since 1833 the Romanians of eastern Serbia have not been able to enjoy the most rudimentary ethnic rights in schools and churches, owing to the refusal of the Serbian State and the Serbian Orthodox Church to accept the Romanian language in those institutions;
Noting the escalation of xenophobic acts and persecution on the part of Serbia’s civil and ecclesiastical authorities towards Romanian Orthodox parishes of the Dacia Ripensis diaconate of the Romanian Historic Diocese for Serbia and Montenegro, as well as the administrative decisions concerning the dismantling of new churches built by the Romanian community in eastern Serbia;
Finding that this situation does not comply with the norms and standards of the Council of Europe,
The Assembly,
Invites the authorities of Serbia and Montenegro to guarantee respect for the fundamental rights and freedoms of members of the Romanian ethnic minority in eastern Serbia as enshrined in the European Convention on Human Rights and particularly their linguistic, cultural and religious rights, including in state schools and churches, along the lines of the model operating in Vojvodina;
Asks the Serbian Government to respect the right of the Romanians of eastern Serbia to designate their own ethnic identity in accordance with the principles of the Council of Europe;
Urges the Serbian authorities concerned to cease proceedings against church-goers and clergymen freely associated with the Romanian Orthodox Church in Serbia and their communities;
Instructs its competent committee to place on the agenda of its next visit to Serbia and Montenegro a meeting with the representatives of the Romanians in eastern Serbia and closely monitor developments regarding this issue.

Violation des droits de l’homme de la minorité nationale roumaine en Serbie
Proposition de résolution
présentée par M. Cubreacov et plusieurs de ses collègues
Considérant les rapports périodiques de ses rapporteurs pour la Serbie-Monténégro sur le fonctionnement des institutions démocratiques dans le pays concerné ;
Constatant que la minorité nationale roumaine habite 39 communes roumaines ou mixtes de la province de Vojvodine, ainsi que 154 communes roumaines et 48 communes mixtes entre le Danube, le Timok et la Morava (Serbie orientale) ;
Regrettant que la Serbie applique des doubles standards en séparant, artificiellement, les Roumains de Vojvodine des Roumains de Serbie orientale en refusant de reconnaître dans le cas de ces derniers leur nom d’auto-identification ethnique (Roumains) et en leur imposant comme identification ethnique le nom de « valaques » ;
Constatant que depuis 1833 les Roumains de Serbie orientale ne peuvent pas jouir des plus élémentaires droits ethniques dans les écoles et les églises, à cause du refus de l’Etat serbe et de l’Eglise orthodoxe serbe d’accepter la langue roumaine dans ces institutions ;
Prenant acte de l’escalade des manifestations xénophobes et des persécutions de la part des autorités civiles et ecclésiastiques serbes à l’encontre des paroisses orthodoxes roumaines du décanat de Dacia Ripensis du Diocèse historique roumain pour la Serbie et Monténégro, ainsi que des décisions administratives concernant le démantèlement des nouvelles églises bâties par la communauté roumaine de Serbie orientale ;
Appréciant que cette situation n’est pas conforme avec les normes et standards du Conseil de l’Europe,
L’Assemblée,
Invite les autorités de Serbie-Monténégro à garantir le respect des droits et des libertés fondamentales des personnes appartenant à la minorité roumaine de Serbie orientale tels qu’inscrits dans la Convention européenne des Droits de l’Homme et notamment des droits linguistiques, culturels et religieux, y compris dans les écoles publiques et les églises, selon le modèle fonctionnant en Vojvodine ;
Demande au Gouvernement serbe de respecter le droit de l’auto-désignation des Roumains de Serbie orientale conformément aux principes du Conseil de l’Europe ;
Lance un appel pressant aux autorités serbes concernées pour qu’elles abandonnent les poursuites contre les fidèles et le clergé librement associés à l’Eglise orthodoxe roumaine en Serbie et leurs communautés ;
Charge sa commission compétente d’inscrire à l’ordre du jour de sa prochaine visite en Serbie-Monténégro une réunion avec les représentants des Roumains de Serbie orientale et de suivre de près l’évolution de cette question.
